This issue does not only apply to bankruptcy attorneys. I have been Legal Secretary/Assistant in a law office since 1970s also and find it to be true of most younger attorneys, especially past few years. I remember the time I was asked to draft a complaint and given NO information, I was supposed to know the meat of this pleading. And when asked by another attorney about one of HIS clients and didn't know the answer he quite assuredly told me I was supposed to be familiar with his clients (this was two months into the job working with him). Thank you for the article. Made me realize I'm not going crazy after all.

Thanks for publishing this. What's next? Will pilots have more modestly paid assistants actually fly the planes instead of flying the planes themselves?

It would be difficult to exaggerate how strongly I deplore "attorneys" such as those you have described. I do not believe that they should be hanged, for at least two reasons: (1) I don't believe in capital punishment, and (2) hanging is too good for them (kidding!) It is my (vain) hope that scumbags such as those you have described will eventually first be turned over to the State Bar, then compelled to disgorge their unearned fees, then lose their license to practice law (since apparently they couldn't be bothered practicing it themselves anyway), then, convicted of the unauthorized practice of law (by forcing unlicensed persons to practice law in their place), then sent to prison, and finally, thrown to the wolves. Well, everything except the last item. (But perhaps when they get out of prison, they should be forced to serve a period of exile in Siberia!)

Thanks again for publishing this.

When cramming down the property through a Chapter 13, does it have to be rental property or can it be the primary residence? Also, does the entire cram down amount need to be paid within the 60 month term of the Plan? Just curious. In Nevada you can cram down anything, except the primary residence, and it must be paid in full during the term. I thought this was very interesting and wanted to learn more information.

It's a problem anytime you need to hire or contract someone. No matter how much you review their resume, interview them, etc. someone can still not perform up to your expectations or be a "good fit" with you and your business and its procedures.
What do you think of short-term contracts as a way to help prevent these sort of problems, Victoria? Say a 90-day contract to begin with and then, if they work out, a longer term one can be signed.

Dear Ms. Ring-

When you say that you "have personally been involved with four law firms who used these tactics," have you reported the 4 firms to the appropriate state bars, bankruptcy courts and the United States Trustee? Not only is this the appropriate ethical (legal or otherwise) action to take, but failing to do so may implicate you in a continuing scheme of bankruptcy crimes.

If you have notified the appropriate authorities, please point me in the direction of those cases.

Thanks.

Victoria,

I just wanted to applaud your decision to be authentic with your readers through this post. It takes great courage to admit our health challenges and to be so bold concerning our faith in Jesus Christ, especially to the great big World Wide Web.

I spent many childhood vacations in Colorado, and I enjoyed seeing the pictures of the beautiful area!

Blessings to you in the new year as you settle into your new surroundings and new way of life! The grace of God will carry you where He takes you!

Wow, Victoria, you've had an ordeal and my blessings to you for that. However, bravo again for you for turning what could have been a negative into a wonderful positive. I'm not a Christian but I see the blessings that you have received and wish you continued success as always. I've followed you for quite some time and I can tell you are a determined spirit who will go the distance as usual. Many continued blessings and get your strength back and much success to you. Peace & Blessings, Simone

This is excellent. It puts in writing something I was starting to feel. Intuitively, I knew something was wrong with my approach. I realized when I socialized at Chamber of Commerce etc., I tried to socialize and tried to find out the needs of others before throwing my card at them. So, same thing with LinkedIn and FB. How interesting!
